North American Windpower: Trillium Power Appeals Court's Offshore Wind Decision

Trillium Power says it has appealed a decision made by Justice Robert Goldstein to dismiss a C$2.25 billion lawsuit filed against the Ontario government in response to its moratorium on offshore wind power development.

In the appeal, Trillium Power claims that in the court's decision, there were errors in both points of law and evidence.

Trillium says it was well advanced in developing wind projects located between 10 km and 120 km offshore in the Great Lakes when the provincial government announced the offshore wind power moratorium in February 2011.

According to the developer, the Ontario government announced the moratorium on offshore wind just one hour before the company was to complete financing arrangements for its TPW1 offshore wind project, which was planned for 28 km offshore in Lake Ontario.

Trillium Power contends that offshore wind developments, appropriately sited from the mainland, should be provided a fair opportunity to follow Ontario’s existing environmental regulations and complete a comprehensive series of studies, reports and public consultations so that Ontarians can make an informed decision about their renewable energy opportunities.
